Waiver & Assumption of Risk Agreement

Untamed Tribe LLC

Effective Date: February 8, 2026

This Waiver & Assumption of Risk Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Untamed Tribe LLC, its owners, guides, employees, contractors, volunteers, affiliates, and agents (“Untamed Tribe”).

By booking, signing, or participating in any Untamed Tribe expedition, course, or activity, Participant agrees to the following:

1. Acknowledgment of Inherent Risk

Participant understands and acknowledges that outdoor and adventure activities involve inherent risks, including but not limited to personal injury, serious bodily harm, death, environmental hazards, wildlife encounters, equipment failure, remote locations with limited medical access, transportation risks, acts of other participants, and acts of nature.

2. Voluntary Participation

Participant voluntarily chooses to participate with full knowledge of the risks involved and understands that participation is not mandatory.

3. Assumption of Risk

Participant knowingly and voluntarily assumes all risks, known and unknown, foreseeable and unforeseeable, associated with participation before, during, and after activities.

4. Release of Liability

To the fullest extent permitted by law, Participant releases and waives any claims against Untamed Tribe LLC arising out of participation, including claims based on negligence.

5. Medical Acknowledgment & Responsibility

Participant acknowledges that Untamed Tribe does not provide medical diagnosis, treatment, or step-by-step medical procedures. Medical care in remote environments may be delayed or unavailable. Participant authorizes emergency medical care if necessary and agrees to be responsible for all associated costs.

6. Physical Fitness & Capability Acknowledgment

Participant acknowledges that Untamed Tribe activities may require a baseline level of physical fitness, mobility, strength, balance, endurance, and mental readiness, appropriate to the specific activity.

Participant represents that they:

  • Meet the minimum fitness requirements communicated for the activity
  • Are capable of sustained physical activity in outdoor and remote environments
  • Can carry required personal equipment and supplies
  • Can follow instructions and respond appropriately to changing conditions

Untamed Tribe LLC does not evaluate participant fitness and relies on the Participant’s representations. If a Participant is unable to safely meet fitness requirements, Untamed Tribe may modify participation or remove the Participant without refund, per the Booking, Payment & Cancellation Policy.

7. Disclosure of Medical Conditions

Participant agrees to disclose relevant medical conditions, allergies, medications, or limitations. Failure to disclose increases risk and is the Participant’s responsibility.

8. Insurance Requirement

Participant acknowledges that independent trip insurance is required and that Untamed Tribe does not provide insurance coverage.

9. Participant Conduct & Compliance

Participant agrees to follow guide instructions, comply with laws and regulations, and behave respectfully. Untamed Tribe may remove any participant posing a safety risk, without refund.

10. International Travel

Participant acknowledges additional risks associated with international travel and is responsible for passports, visas, vaccinations, and compliance with foreign laws.

11. Use of Tracking & Emergency Systems

Participant acknowledges the use of GPS tracking or satellite communication devices for safety purposes and understands these systems do not guarantee rescue.

12. Photo & Media Release

Participant grants permission for the use of photos or video taken during activities for promotional or educational purposes.

13. Severability

If any provision is held unenforceable, remaining provisions remain in effect.

14. Governing Law & Venue

This Agreement is governed by the laws of the State of Florida. Venue is exclusive to Florida courts.

15. Acknowledgment & Acceptance

By booking, signing, or participating, Participant confirms they have read, understood, and voluntarily agreed to this Agreement.

Minor Participant Consent & Liability Release Addendum

Effective Date: February 8, 2026

This Addendum applies to participants under eighteen (18) years of age and supplements the Waiver & Assumption of Risk Agreement.

1. Parent / Guardian Authority

I certify that I am the parent or legal guardian of the Minor and have authority to grant consent on their behalf.

2. Consent to Participation

I grant permission for the Minor to participate in Untamed Tribe activities, acknowledging participation is voluntary.

3. Acknowledgment & Assumption of Risk

I acknowledge that outdoor activities involve inherent risks and voluntarily assume all risks on behalf of myself and the Minor.

4. Release & Waiver of Liability

To the fullest extent permitted by law, I release Untamed Tribe from claims arising from the Minor’s participation, including claims based on negligence.

5. Medical Authorization

I authorize emergency medical care for the Minor if necessary and accept responsibility for all associated costs.

6. Minor Fitness & Capability Certification

I certify that the Minor meets the minimum physical fitness, mobility, and endurance requirements communicated for the activity.

I acknowledge that participation may require sustained physical activity, carrying equipment, navigating uneven terrain or water, and responding appropriately to instructions and conditions.

Untamed Tribe does not evaluate fitness and relies on my representations. If the Minor cannot safely meet fitness demands, Untamed Tribe may modify or end participation without refund, per the Booking, Payment & Cancellation Policy.

7. Disclosure of Medical Information

I agree to disclose relevant medical conditions, allergies, medications, or limitations affecting the Minor.

8. Insurance Acknowledgment

I acknowledge that independent trip insurance is required for the Minor.

9. Conduct & Compliance

The Minor must follow all guide instructions and behave responsibly. Untamed Tribe may remove the Minor for safety or conduct concerns, without refund.

10. Governing Law

This Addendum is governed by the laws of the State of Florida.

11. Acknowledgment & Acceptance

By purchasing any skills training or expedition, I confirm I have read and agreed to this Addendum and the primary Waiver & Assumption of Risk Agreemento.
