These Terms and Conditions (“Terms”) govern your access to and use of Untamed Tribe LLC’s website, booking platforms, and services, including participation in guided expeditions, courses, and activities (“Services”).
By accessing our website, making a reservation, or participating in an Untamed Tribe activity, you agree to be bound by these Terms.
1. Services
Untamed Tribe LLC provides guided outdoor and adventure expeditions, instruction, and related services in the United States and internationally.
All Services are subject to availability, environmental conditions, safety considerations, and guide discretion.
2. Bookings, Payments & Cancellations
All reservations, payments, deposits, refunds, and cancellations are governed exclusively by Untamed Tribe’s Booking, Payment & Cancellation Policy, which is incorporated into these Terms by reference.
By making a reservation, you acknowledge that you have reviewed and agreed to that policy, including:
- Non-refundable deposits
- Payment deadlines
- Refund limitations
- The requirement to obtain independent trip insurance
In the event of any conflict, the Booking, Payment & Cancellation Policy shall control.
3. Assumption of Risk & Waivers
Outdoor and adventure activities involve inherent risks, including but not limited to injury, illness, environmental hazards, equipment failure, wildlife encounters, and acts of nature.
All participants are required to sign a Waiver and Assumption of Risk Agreement prior to participation. That waiver is incorporated into these Terms by reference.
Failure or refusal to sign the waiver will result in denial of participation, without refund.
4. Participant Responsibilities
You agree to:
- Accurately represent your physical condition, experience, and health
- Follow all guide instructions and safety protocols
- Comply with local laws, customs, and regulations
- Maintain required insurance coverage
- Behave respectfully toward guides, staff, other participants, and local communities
Untamed Tribe reserves the right to remove any participant whose conduct or condition poses a safety risk or disrupts the group, without refund.
5. Changes, Interruptions & Early Departure
Trips may be modified, delayed, interrupted, or canceled due to weather, safety concerns, environmental conditions, logistical constraints, or other factors beyond our control.
No refunds or credits are provided for itinerary changes, interruptions, or early departures, as detailed in the Booking, Payment & Cancellation Policy.
6. International Travel
International expeditions involve additional risks and third-party dependencies.
Participants are responsible for:
- Valid passports and visas
- Compliance with customs and immigration laws
- International medical and evacuation insurance
Untamed Tribe is not responsible for losses related to travel delays, border restrictions, government actions, denied entry, or third-party service failures.
7. Privacy & Data Protection
Untamed Tribe’s collection and use of personal information is governed by its Privacy Policy, including the GDPR & International Data Protection Addendum, which are incorporated into these Terms by reference.
In the event of any conflict, the Privacy Policy shall control with respect to data protection and privacy matters.
8. Intellectual Property
All content on Untamed Tribe’s website and materials, including text, logos, images, and branding, is the property of Untamed Tribe LLC and may not be copied, reproduced, or used without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Untamed Tribe LLC shall not be liable for indirect, incidental, consequential, or special damages arising from participation in Services, including personal injury, property loss, travel disruptions, or financial losses.
10. Indemnification
You agree to indemnify and hold harmless Untamed Tribe LLC, its owners, guides, employees, and contractors from any claims, damages, or liabilities arising from your participation, conduct, or breach of these Terms.
11. Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in courts located in Florida.
12. Modifications
Untamed Tribe reserves the right to update these Terms at any time. Updates will be posted on our website with the revised effective date.
Continued use of Services constitutes acceptance of the updated Terms.
